WAIVER OF LIABILITY
I, understand as a condition to the rental from MS Entertainment, Inc. D.B.A. Kids Play Rentals. (hereinafter referred to as Party of the Second Part), do hereby understand and agree to the following terms and Conditions:
(A) I recognize that there is an inherent danger associated with the improper use of the Rented Item(s) and assume the risk concerning the utilization of the Rented Item(s) during all such times that said Rented Item(s) is/are in my possession;
(B) I agree to oversee and accept responsibility for any and all individuals utilizing the Rented Item(s) at any time that the Rented Item(s) is/are in my possession;
(C) I understand that children under the age of eighteen (18) years should not be allowed on or near the Rented Item(s) while unattended or without adult supervision and I hereby agree that I will oversee and supervise any and all minor children utilizing the Rented Item(s) is/are in my possession.
(D) I agree to waive any and all liability against the Party of the Second Part and agree to defend, indemnify and hold harmless the Party of the Second Part concerning or against any claim, expense, loss or liability that may arise as a result of my use or the condition of the above-described Rented Item(s); or as a result of a manufacturer’s defect concerning the Rented Item(s); or as a result of the carelessness, negligence or improper conduct of the Party of the Second Part, their agents, servants, contracted labor as well as any visitors or licensees; or as a result of any duty, arising under statute or common law, owed to me by the Party of the Second Part.
I hereby agree and acknowledge that I have read and agree to the above-stated terms and conditions and agree to be responsible for any and all individuals utilizing the above-described Rented Item(s) during any and all times in which such Item(s) is/are in my possession.
